THIS COMMENT DISCUSSES THE IMPLICATIONS OF A SUPREME COURT DECISION UPHOLDING A VIRGINIA SODOMY STATUTE WHICH CRIMINALIZED ORAL AND ANAL SEX BETWEEN MEMBERS OF THE SAME OR OPPOSITE SEX MARRIED OR UNMARRIED.
Abstract
THE COMMENT CONCLUDES THAT THIS DECISION CAN BE REGARDED ONLY AS A DETERMINATION BY THE SUPREME COURT TO CLOSE THE DOOR QUIETLY BUT FIRMLY ON ANY PROSPECT FOR RECOGNIZING THE RIGHT OF SEXUAL PRIVACY FOR ALL CONSENTING ADULTS IN THE FORESEEABLE FUTURE, NOTWITHSTANDING PERVASIVE DUE PROCESS AND EQUAL PROTECTION ARGUMENTS TO THE CONTRARY.
