Abstract
The first part covers limits on law enforcement practices and procedures. Cases deal with confessions and interrogations, eyewitness identification procedures, wiretapping and electronic surveillance, exclusionary principles and alternative remedies for unlawful investigative practices, and limits of undercover work. The second part examines the judicial process, focusing on prosecutorial discretion, rights of indigents in formal criminal proceedings, preliminary hearings, and grand jury proceedings. This part also includes cases that consider right to bail, pretrial motions, competency to stand trial, disclosure and discovery, pleas, trial by jury, quality of representation by counsel, sentencing alternatives, post-trial motions, and appellate and other post-trial remedies. A table of cases is provided.
