This digest consists of criminal cases concerning domestic violence and will be accompanied by a companion volume focusing on civil cases. It also includes a bibliography of law review articles from journals and periodicals.
Abstract
The first section of cases focuses on substantive crimes and defenses including marital exemption for rape, deterrence of crimes that disrupt marriage, violent boyfriends, protective orders versus ownership, great bodily injury, and the battered woman syndrome defense. Pretrial criminal procedural issues covered here include a husband's violation of a court protection order, contempt actions, and the admissibility of communications between a battered woman and her counselor. Criminal procedural issues which may arise during trial include, inter alia, expert testimony on battered woman syndrome, evidence of prior bad acts, and children's testimony. The final section deals with dispositional issues related to violent sex offenses, revocation of probation, and victim's statements.
