This analysis concludes that the rights, needs and interests of crime victims of New York State have often been ignored or underserved by the State's criminal justice system and recommends expansion of victim restitution, compensation, and assistance as well as the implementation of the 15 victim rights listed in the proposed Bill of Rights for Crime Victims.
Abstract
An overview is presented of other States' programs providing victim compensation. The eligibility requirements of various programs are compared and contrasted with the New York program. Restitution is examined from a historical standpoint and in terms of the benefits of expanding its currently limited use in New York. An analysis of civil liability processes as a means for victims to recover losses from crime concludes that this area of tort law will continue to grow. Crisis intervention and other services for victims and witnesses are also discussed, with recommendations for continuing evaluation and increased State support. Tables and chapter notes.
