European Committee on Crime recommendations on computer-related crime are discussed.
Abstract
On 13 September 1989, the Committee of Ministers adopted a Recommendation calling on member states of the Council of Europe to take into account, when reviewing their legislation, the report on computer-related crime elaborated by the European Committee on Crime problems between 1985 and 1989. The report is divided into five chapters: (1) General Questions; (2) Guidelines for national legislatures; (3) Procedural law problems; (4) International aspects; and (5) Other aspects of computer-related crime. One of the main areas of Council of Europe work in the field of crime problems is the treatment of offenders. With respect to offenders in institutions, the Council subscribes to the basic principles of further humanization of imprisonment, improvement of the conditions of detention and promotion of measures aimed at reducing the negative side-effects of imprisonment and facilitating the return of the prisoner to the community. The Recommendation and the report both assign a prominent place to education in prisons. Education should have no less a status than work within the prison regime, and prisoners should not lose out financially or otherwise by taking part in education.
