THIS COMPREHENSIVE SURVEY OF CONSUMER PROTECTION LAW IN GREAT BRITAIN PROVIDES GENERAL COVERAGE OF LAWS AFFECTING THE CONSUMER, AS WELL AS A DETAILED EXAMINATION OF LEGAL CONTROLS OVER SALES, CREDIT, AND HIRE AGREEMENTS.
Abstract
WRITTEN FOR INDIVIDUALS WITH AN ACADEMIC OR PROFESSIONAL INTEREST IN CONSUMER PROTECTION LAW, THE BOOK FIRST DESCRIBES COMMON LAW AND THE STATUTES WHICH PROTECT THE INDIVIDUAL CONSUMER FROM EXPLOITATION. THE SALE OF GOODS ACT OF 1893 AND THE CONSUMER CREDIT ACT OF 1974 ARE THE CRUCIAL ENACTMENTS IN CONSUMER LAW. TRANSACTIONS WHICH ARE GOVERNED IN WHOLE OR IN PART BY THESE LAWS ARE EXAMINED, INCLUDING CONTRACTS OF SALE OF GOODS, CONTRACTS FOR WORK AND MATERIALS, HIRE-PURCHASE AGREEMENTS, CONDITIONAL SALES, CREDIT SALES, CASH LOANS, AND SECURED OR UNSECURED CREDIT. REGULATIONS ESTABLISHED BY THE CONSUMER CREDIT ACT FOR BUSINESSES THAT PROVIDE CREDIT SERVICES ARE DISCUSSED, FOLLOWED BY CHAPTERS ON LICENSING, ADVERTISING, AND FALSE OR MISLEADING TRADE DESCRIPTIONS. BEGINNING WITH A GENERAL TREATMENT OF LIABILITY AS TO QUALITY AND SAFETY, THE BOOK SUMMARIZES THE RELEVANT STATUTES. TRADING PRACTICES AND THE FAIR TRADING ACT OF 1973 ARE CONSIDERED, AS ARE ENFORCEMENT ASPECTS OF ALL STATUTES, SUCH AS POWERS OF LOCAL AUTHORITIES, PROSECUTIONS, LIABILITIES, AND DEFENSES. METHODS THAT CONSUMERS CAN USE TO AVOID LIABILITY AND PROTECT THEIR RIGHTS ARE PRESENTED. DETAILED RULES WHICH RELATE TO SPECIFIC TYPES OF SALES, CREDIT, AND HIRE AGREEMENTS ARE DESCRIBED. TOPICS EXAMINED IN THIS SECTION INCLUDE QUALITY AND FITNESS OF GOODS, THE NEMO DAT RULE OF ENGLISH LAW, AND REMEDIES AVAILABLE TO BOTH PARTIES. CASE EXAMPLES AND SECTIONS OF STATUTES ARE CITED THROUGHOUT THE BOOK. FOOTNOTES AND SEPARATE INDEXES FOR CASES, STATUTES, AND SUBJECTS ARE PROVIDED.
