RESULTS OF TWO RESEARCH PROJECTS CARRIED OUT BY THE RESEARCH AND DOCUMENTATION CENTER OF THE DUTCH MINISTRY OF JUSTICE WITH REGARD TO FACTORS INFLUENCING PROSECUTION AND SENTENCING POLICIES IN THE NETHERLANDS.
Abstract
THE STUDIES AIM AT ASSESSING THE INFLUENCE OF SOCIAL CLASS ON THE DECISION TO PROSECUTE AND ON THE SENTENCE GIVEN. RESULTS INDICATE THAT WITH THE EXCEPTION OF ASSAULT AND BATTERY, THERE IS NO SIGNIFICANT CORRELATION BETWEEN SOCIAL CLASS, PROSECUTION, AND SENTENCING. HOWEVER, THE VALUE OF GOODS STOLEN OR DAMAGED AND THE QUESTION OF WHETHER THE INJURED PARTY IS A PRIVATE PERSON OR A PUBLIC COMPANY IS A CONSIDERABLE INFLUENCE ON PROSECUTION AND SENTENCING. --IN DUTCH
