The 12 chapters of this book describe the interpretation, implementation, and impact of laws in England and Wales which govern State-funded and offender-funded compensation for victims of personal crime.
Abstract
Several chapters address the interpretation that the courts and the Criminal Injuries Compensation Board (CICB) have given to the terms of the Criminal Injuries Compensation Scheme over the past 25 years as well as the changes that have been made as a result of revisions which became effective February 1, 1990. These revisions substitute for the commencement of the stautory scheme as established in the Criminal Justice Act 1988. Other chapters examine the provisions of the Powers of Criminal Courts Act 1973 which govern the making of compensation orders upon conviction. The book concludes with a review of the various proposals that have been made to establish a victim compensation fund. These proposals include a recommendation that the compensation of victims of personal crime would be better served by arrangements which, if not part of a wider accident compensation scheme, at least made compensation available to all such victims above a much lower financial threshold than now obtains under the scheme and irrespective of the offender's means. 1,026 footnotes, 2 tables, and 4 appendixes
