A COMPARATIVE REVIEW OF THE LEGAL AND PROCEDURAL ASPECTS OF EXISTING STATE VICTIM COMPENSATION SYSTEMS, WITH A DISCUSSION OF THE LEGAL AND POLICY ISSUES WHICH MUST BE RESOLVED WHEN ENACTING SUCH A SYSTEM.
Abstract
FIRST DISCUSSED ARE THE TYPES OF CRIMES WHICH MAY OR MAY NOT BE COVERED BY VICTIM COMPENSATION PLANS. IT IS NOTED THAT UNDER MOST OF THE EXISTING SYSTEMS, CRIMINALLY CAUSED INJURY TO PROPERTY IS EXCLUDED. OTHER COMMON LIMITATIONS TO VICTIM COMPENSATION ARE ALSO REVIEWED. THE AUTHOR THEN EXAMINES SEVERAL DIFFERENT CATEGORIES OF DAMAGES WHICH MAY BE PAID AND NOTES WHICH STATES AND COUNTRIES PROVIDE FOR EACH TYPE OF DAMAGES. ALSO DISCUSSED ARE AVOIDANCE OF DOUBLE COMPENSATION, METHODS OF PAYMENT, GEOGRAPHIC SCOPE OF THE PLANS, REIMBURSEMENT OF THE STATE BY THE OFFENDER, AND ADMINISTRATIVE AND PROCEDURAL MATTERS.
