THIS ARTICLE TRACES THE DEVELOPMENT OF THE MANY CHANGES IN CRIMINAL INSANITY COMMITMENT AND RELEASE PROCEDURES WHICH HAVE OCCURRED IN NEW JERSEY BETWEEN 1972 AND 1974.
Abstract
IN ADDITION, THE ARTICLE DEMONSTRATES HOW MOST OF THESE CHANGES AND DEVELOPMENTS HAD THEIR ANTECEDENTS IN PRECEDING CASES: THAT THE ESTABLISHMENT OF THE CONDITIONAL RELEASE CONCEPTS HAD BEEN ALLUDED TO; AND THAT THE CASE IN WHICH THE CONDITIONAL RELEASE CONCEPT HAD BEEN ESTABLISHED HAD SIGNIFIED THE NEED TO EXAMINE STATUTORY PROVISIONS FOR COMMITMENT AND RELEASE PROCEDURES AS WELL AS THE CONTINUED VIABILITY OF EARLIER DECISIONS IN CONJUNCTION WITH THE CONSTITUTIONAL PRINCIPLES OF EQUAL PROTECTION AND DUE PROCESS.
