This book provides information to aid general practitioner attorneys in identifying labor relations cases they are competent to handle and suggests approaches to common labor relations legal problems.
Abstract
The first chapter reviews features of the National Labor Relations Act and the administrative structure of the National Labor Relations Board (NLRB), including its functions and procedures. A chapter on collective bargaining units considers the general principles governing NLRB decisions on appropriate bargaining units and the formation of and withdrawal from multiemployer collective bargaining units. The chapter dealing with employer unfair labor practices focuses on employer premature recognition of an unauthorized union, employer conduct during the employee union selection process, and discharges and strikers' rights. Other issues considered in separate chapters are collective bargaining orders in lieu of union selection by election, statutory protection for labor activity in the absence of a labor organization, and an employee's right to representation in a predisciplinary interview. Remaining chapters address fair representation of employees in collective bargaining, union pressure on consumers to boycott an employer's product or service, regulation in the construction industry, and the NLRB's deferral to arbitration.
