EVALUATION OF THE POSITION AND THE IMPACT OF THE PSYCHOLOGICAL EXPERT IN THE CRIMINAL PROCESS IN YUGOSLAVIA.
Abstract
PSYCHOLOGY IN YUGOSLAVIA HAS ASSERTED ITSELF WITHIN THE CRIMINAL PROCESS ONLY IN THE LAST 15 YEARS AND HAS PRIMARILY FOCUSSED ON JUVENILES. THE SPECIFIC CONTRIBUTION OF THE PSYCHOLOGIST TO THE CRIMINAL PROCEDURE CONSISTS OF PERSONALITY ANALYSIS. THE AUTHOR PLEADS FOR PRETRIAL ANALYSIS. THIS COULD BENEFIT THE PARTICIPANTS IN THE PROCEEDINGS AS WELL AS ADD TO THE QUALITY OF THE SENTENCE WITH REGARD TO REHABILITATION AND RESOCIALIZATION OF THE OFFENDER. IN SPITE OF THE PRACTICAL VALUE OF THE PSYCHOLOGIST'S REPORT THE AUTHOR WARNS AGAINST THE STIGMATIZING EFFECT THE REPORT COULD HAVE ON THE DEFENDANT.
