This manual instructs Kansas sheriffs and deputies in Kansas civil process statutes bearing upon the delivery of a copy of the process, the removal or taking custody of a person, the seizure of certain property, and the eviction of a party.
Abstract
Delivery of a copy of the civil process may involve a summons, witness subpoena, order to show cause, order of garnishment, injunction, restraining order, or habeas corpus. In the delivery of a summons, sheriffs and deputies must be knowledgeable in individual service under the code of civil procedure and the code of civil procedure for limited actions, small claims procedures, governmental bodies, corporations and partnerships, service on attorney, proof of service, juvenile proceedings, and location checklist. The removal or taking temporary custody of a person may involve processing under a forcible detainer, ejectment, temporary divorce orders, mentally ill persons, alcoholic and intoxicated persons, and bench warrants. The possession process may involve bankruptcy, executions, replevin and foreclosure of security interest, and tax matters. Extrinsic factors to be considered are process fees, liability problems, computation of time, substantial compliance, and animal problems. Appended are a glossary of terms, forms used in civil processing, an index to statutes, and guidance and testing in the handling of a practical problem in executions. A subject index is also provided.
