After reviewing the origins of American juvenile justice, this book summarizes court cases pertinent to various aspects and phases of juvenile justice procedures.
Abstract
The cases in one chapter focus on the variety of contacts between juveniles and police. It presents the fundamental rights enjoyed by juveniles and the differences in police treatment of juveniles when no landmark cases are established to guide such interaction. Another chapter presents cases that address issues associated with the use of curfew ordinances to restrict the movements of juveniles during certain time periods. A chapter profiles cases that deal with the legal and constitutional issues regarding the housing of juveniles in detention facilities, followed by a chapter that features cases on post-police, pre-adjudication processes that involve juveniles. Other chapters summarize cases that deal with the waiver of juveniles to adult court, juvenile adjudication, the disposition of juveniles, conditions of confinement and liability for failure to protect, the release and revocation of juveniles, and the privacy and confidentiality of juvenile records and proceedings. The format for presenting each case consists of the facts, the issue, the decision, the court's reasoning, and the significance of the case.
