Intended to assist commanding, executive, legal, and discipline officers in discharging their responsibilities under the Uniform Code of Military Justice, this handbook explains the legal principles and procedures of the military justice system.
Abstract
A section on evidence explains rules pertaining to the forms, types, and admissibility of evidence. Separate chapters cover the law of privileged communications, self-incrimination, search and seizure, discovery, and requests for witnesses. A section on criminal procedure discusses military justice investigations, informal disciplinary measures (nonpunitive measures), nonjudicial punishment, and the court martial process. The latter addresses the summary court and special court martial, pretrial matters, and the review of court martials. The third section, provided primarily for use by commanders and their legal officers, focuses on elements of common offenses under the Uniform Code of Military Justice. These include solicitation, conspiracy, dereliction of duty, disrespect, assaults, absence offenses, drug offenses, drunkenness, and property offenses. General defenses for these crimes are reviewed. Remaining sections present a glossary and common military justice abbreviations.
