This volume explores the gradual recognition of the rights of minors to a voice in legal matters that affect them, describes situations that have been questioned to the point where laws changed in response, and examines issues currently being debated.
Abstract
The analysis focuses on each major legal issue that affects children and young people. These include child custody, the child’s right to safety, criminal issues, freedom of speech, the right to privacy, discrimination, and child labor laws. The discussion of each topic begins with a case received wide attention and that raised central issues. The text then discusses the history of each issue and outlines the current status and unanswered questions. The information is intended for child advocates, other adults, and youth. The analysis concludes that a delicate balance of power has to be maintained between the child, the parent, and the government. Children have some independent rights, parents have the rights and responsibilities concerning their children, and the government has an obligation to protect children. Each era brings its own political, social, and economic challenges and will experience inevitable conflicts as each entity pursues its own standard of preserving the best interests of the child.
