LEGAL ASPECTS OF TRANSNATIONAL TERRORISM DIRECTED AT AIRCRAFT AND AVIATION FACILITIES ARE DISCUSSED, WITH ATTENTION TO THE CHARACTER OF SUCH ATTACKS AND NATIONAL AND INTERNATIONAL MEASURES FOR THEIR CONTROL.
Abstract
THE THRUST OF INTERNATIONAL TERRORISM AGAINST CIVIL AVIATION REACHES NOT ONLY THE HIJACKING OF AIRCRAFT BUT ALSO THE SABOTAGE OF AIRCRAFT IN FLIGHT AND ON THE GROUND, FORCED FLIGHTS, AND ATTACKS ON AVIATION FACILITIES, INCLUDING TERMINALS, TRANSIT AREAS, BAGGAGE AND CUSTOMS AREAS, HANGARS, AND CONTROL TOWERS. THE RECOGNITION BY GOVERNMENTS OF THEIR MUTUAL RESPONSIBILITY FOR THE PROTECTION OF INTERNATIONAL CIVIL AVIATION--AS EVIDENCED BY THEIR COMMITMENT TO THE TOKYO, HAGUE, AND MONTREAL CONVENTIONS, AND BY THEIR APPLICATION AND ENFORCEMENT OF PREVENTION MEASURES--HAS REDUCED TERRORIST ATTACKS AGAINST AIR CARRIERS. HOWEVER, DESPITE THESE MEASURES, THERE ARE SUFFICIENT NUMBERS OF SERIOUS INCIDENTS INVOLVING TRANSIT AND BAGGAGE AREAS, AIRCRAFT NOT IN SERVICE, AND URBAN AIR TERMINALS AS TO REQUIRE SOME ATTENTION TO ESTABLISHING BY CONVENTION INTERNATIONAL STANDARDS FOR THE PROTECTION OF THESE AREAS AS WELL. NEITHER SHOULD THE DESIRABILITY OF A CONVENTION FOR THE ENFORCEMENT--BY SANCTIONS--OF THE TOKYO, HAGUE, AND MONTREAL CONVENTIONS BE OVERLOOKED. IF STATE AUTHORITIES ARE NOT ALERT TO THE NEED FOR DEVELOPING MEASURES OF CONTROL FOR THE PROTECTION OF INTERNATIONAL CIVIL AVIATION, THESE MATTERS WILL BE BROUGHT TO THEIR ATTENTION THROUGH POLITICAL AND ECONOMIC ACTIONS ON THE PART OF PRIVATE ORGANIZATIONS (E.G., STRIKES BY PILOTS, CURTAILED AIR SERVICE TO FOREIGN AIRPORTS NOT FULLY SUBSCRIBING TO PREVENTION MEASURES). CONCERTED ACTION ON THE PART OF STATES TO SUBMIT INTERNATIONAL TERRORISTS TO PROSECUTION AND THE WIDE PUBLICATION OF THE RESULTS OF SUCH PROSECUTION MAY PROVIDE A DETERRENT EFFECT EQUAL TO THAT OF STANDARDIZED PREVENTION EFFORTS. RECOMMENDATIONS FOR UNILATERAL, BILATERAL, AND MULTILATERAL ACTION ARE PROVIDED, ALONG WITH REFERENCE NOTES. TABULAR SUMMARIES OF LEGISLATION RELATING TO THE CONTROL OF AIRCRAFT HIJACKING, NATIONS SUBSCRIBING TO RELEVANT AVIATION CONVENTIONS, AND DOMESTIC AND FOREIGN HIJACKINGS BETWEEN JANUARY 1, 1960 AND JULY 31, 1977 ARE APPENDED.
