This review of all the Federal, State, and local laws potentially applicable to AIDS in the workplace also analyzes various AIDS employment issues, identifies the advantages and drawbacks of alternative approaches, and recommends courses of action that are consistent with legal precedent and protective of legitimate business concerns.
Abstract
General considerations involving AIDS in the workplace revolve around medical, social, ethical, legal, and business factors. Federal laws which apply to the situation include, inter alia, the Americans with Disabilities Act, the Civil Rights Act, and the National Labor Relations Act. The chapter on State laws discusses employment-at-will, multiple claims, jurisdiction, potential remedies, public health laws, and insurance. Separate chapters examine issues related to unions, arbitration, and compensation, as well as HIV testing policies. Three chapters cover AIDS and health care from the perspectives of the patient, health care providers, and institutions. The book provides a framework for preventing AIDS claims, a list of 30 defenses to AIDS lawsuits, and guidelines for employer policies and procedures. 4 appendixes
