This book assesses the status of AIDS law by examining such issues as the right of AIDS patients to privacy, employment, treatment, public services, and insurance, along with the legal obligations of health care workers, blood banks, prisons, and people who have sex with each other.
Abstract
Written by leading policymakers, attorneys, scholars, and physicians, the book discusses AIDS transmission and treatment, public health measures to stem the AIDS epidemic, HIV issues in the health care setting, employment and housing discrimination, AIDS education, liability for risky behavior, HIV in prisons, and insurance coverage of persons with AIDS. The book also includes chapters on criminal law, privacy, the twin epidemics of HIV and substance abuse, and reproduction and parenting issues. Book editors deal with the many social conflicts generated by AIDS that challenge ideals of fairness and the legal system. Consideration is given to AIDS-related State and Federal laws and constitutional rights, court procedures, burden of proof, judicial decisionmaking, and the administrative hearing process. Notes
