Focusing on life behind bars, this article addresses a prisoner’s rights in regards to issues concerning AIDS.
Abstract
Arguing that prisoners should retain as many civil rights as possible, the author of this journal article examines how the European Convention on Human Rights (ECHR) is handling the issue of prisoners’ rights in light of AIDS. Highlighting situations of prisoners having AIDS behind bars and prisoners being exposed to high risks of HIV transmission, the author discusses the ways that the United Kingdom, Australia, and the United States each handle the issue of prisoners’ human rights. Discussions of testing for HIV in prison, of maintaining patient confidentiality, and of the denial of adequate HIV medical treatment and HIV transmission prevention in prison conclude with the author maintaining that the ECHR may be used in order to prevent AIDS related human rights violations in prison.
