Evidence-based prosecution, otherwise known as "victimless" prosecution, is an approach whereby prosecutors build a case based on available evidence irrespective of the victim's willingness to participate in the case or testify.

The key question is whether or not a case is provable, beyond a reasonable doubt, based on the corroborating evidence available.

If the answer is "yes", we should be proceeding even absent the victim's participation or cooperation.

This seminar will explore the concept of evidence-based prosecution, focusing on the types of evidence available, working with law enforcement to document and secure evidence that proves the elements of the offense, and trial strategies including the use of lay witnesses, experts, and medical professionals.
