THIS MANUAL PRESENTS THE ADMINISTRATIVE RULES GOVERNING THE YOUTH PAROLE AND REVIEW BOARD OF THE MICHIGAN DEPARTMENT OF SOCIAL SERVICES.
Abstract
THE BOARD HAS THREE MEMBERS. PETITIONS TO THE BOARD MAY BE FILED BY A WARD, DEPARTMENT PERSONNEL, PROSECUTING ATTORNEY, STATE ATTORNEY GENERAL, JUVENILE COURT STAFF, LAW ENFORCEMENT AUTHORITY, PARENT OR GUARDIAN, INTERESTED MEMBERS OF THE COMMUNITY, OR A BOARD MEMBER. GENERAL RULES OF PROCEDURE COVER PETITIONS, PRELIMINARY INQUIRY, REQUIRED DOCUMENTS, HEARINGS, THE PRESIDING OFFICER'S POWERS AND DUTIES, PARTIES' REPRESENTATION, SETTLEMENTS, AND HEARINGS. THE SECTION ON RELEASES OF WARDS FROM INSTITUTIONS COVERS CRITERIA FOR APPROVAL OF RELEASES, THE DECISION ON RELEASE, AND CONDITIONS FOR RELEASE. CONDITIONS INCLUDE SUPERVISION, APPROVED PLACE OF RESIDENCE, AND AVOIDANCE OF LAW VIOLATIONS. UPON VIOLATION OF CONDITIONS, THE JUVENILE MAY BE RETURNED FROM RELEASE, FOLLOWING A HEARING. PROCEDURES FOR DISCHARGE OF A WARD ARE ALSO PRESENTED. THE BOARD MAY ALSO CONDUCT INFORMAL REVIEWS OF A WARD'S RECORDS AT ANY TIME. ANNUAL REVIEWS ARE HELD FOR ALL WARDS ASSIGNED TO INSTITUTIONS FOR 1 YEAR OR MORE. OTHER PROCEDURES DESCRIBED INCLUDE REHEARINGS AND APPEALS. (CFW)
