CRITICAL REVIEW OF HOW FEDERAL JUDGES ARE SELECTED AND THE ROLES PLAYED BY INDIVIDUAL U.S. SENATORS, THE AMERICAN BAR ASSOCIATION STANDING COMMITTEE ON THE FEDERAL JUDICIARY, AND THE SENATE JUDICIARY COMMITTEE.
Abstract
THE AUTHOR NOTES THAT NOMINATIONS ARE USUALLY BASED ON POLITICAL CONSIDERATIONS AND CITES INSTANCES WHERE POLITICS HAS ALLOWED UNQUALIFIED CANDIDATES EITHER TO BE NOMINATED FOR A JUDGESHIP OR TO REMAIN ON THE FEDERAL BENCH. IT IS SUGGESTED THAT THE SELECTION SYSTEM BE REFORMED, WITH THE SENATE JUDICIARY HIRING A STAFF TO SCREEN JUDGES AND REQUIRE WRITTEN EXPLANATIONS FOR EACH OF THE AMERICAN BAR ASSOCIATIONS RATINGS ON EACH NOMINEE. ALSO RECOMMENDED IS THAT THE COMMITTEE UTILIZE LONG FORMS THAT ELICIT PERTINENT FINANCIAL, HEALTH, AND CAREER INFORMATION FROM EACH NOMINEE.
