In the context of heightened public awareness of white-collar crimes and their costs to society and the victim, these law journal articles deal with the investigation and prosecution of various white-collar crimes under Federal law.
Abstract
Articles examine such legal aspects of the new emphasis on white-collar crime control as the administrative summons, parallel civil and criminal suits with the attendant problems of discovery, fifth amendment privileges, due process considerations, double jeopardy and collateral estoppel, and legal remedies available to defendants faced with parallel suits. The types of white-collar crimes examined here include mail and wire fraud, conspiracy, violations of the Travel Act, conflicts of interest and bribery, extortion, perjury, and false statements. Also discussed are defrauding the Government through the filing of false claims, such as Medicare and Medicaid fraud; violations of the Foreign Corrupt Practices Act; tax fraud; racketeering; antitrust violations; Federal food and drug violations; environmental crime, such as water and air pollution; and computer crimes. Relevant judicial decisions are cited for each type of white-collar crime as well as enforcement measures, defense considerations, and penalties. Also mentioned are the elements of and constitutional challenges to the Racketeering Influenced and Corrupt Organizations statute. Extensive footnotes are included.
