THIS STUDY PROPOSES THAT THE TREATMENT MODELS NOW IN FAVOR IN CORRECTIONAL INSTITUTION MANAGEMENT BE REPLACED WITH A 'JUSTICE IN ADMINISTRATION' MODEL THAT WOULD ASSURE FAIR TREATMENT TO ALL PRISONERS.
Abstract
THIS MODEL ASSUMES THAT THE BEST WAY TO INDUCE AN INMATE TO OBEY THE LAW IS TO TREAT HIM ACCORDNG TO THE LAW AND AS OTHER INMATES ARE TREATED. THE FIRST CHAPTER DEALS WITH THE INCONGRUITIES OF AMERICAN PRISON HISTORY. THE NEXT CHAPTER EXAMINES THE INHERENT CONTRADICTIONS, AND NEGLECT AND THE FOSSILIZATION OF THE ROLE OF CUSTODIAN, AND SUGGESTS SOME NEW DIGNIFIED ROLES. THE THIRD DEALS WITH THE RELATED PHENOMENA OF REHABILITATION PROGRAMS ATTEMPTED DURING THE LAST QUARTER-CENTURY AND THE BURGEONING CORRECTIONAL CASE LAW OF THE LAST DECADE. IN THE FOURTH CHAPTER THE AUTHOR ADVOCATES VIEWING THE CRIMINAL AS LARGELY VOLITIONAL AND PROPOSES AN ELABORATE JUSTICE MODEL FOR PRISON ADMINISTRATION THAT WOULD IMPOSE A NARROWING OF DISCRETION IN SENTENCING, PAROLE, AND ADMINISTRATION. THE FINAL CHAPTER EXAMINES THE RESIDUAL OFFENDER WHO MUST BE INCAPACITATED, BEHAVIOR MODIFICATION TECHNIQUES, AND A SUNSHINE POLICY FOR PRISON ADMINISTRATIONS.
