The authors examine penalties for firearms offenses and whether gang membership and gang-related crime should be incorporated as a sentencing factor.
Abstract
The examination of violent crimes and firearms focuses on whether the present guideline penalties for these offense types are adequate and whether there are specific application problems associated with these guidelines. The purpose of the gang study was to lay the groundwork for an examination of issues pertinent to incorporating gang membership and gang-related crime as a sentencing factor. The report is presented in chapters on Violent Crimes (Offenses Against the Person), Firearms, and Gangs. The chapters include some or all of the following categories of data: Background, Case Law, Legislative History, Expert Assistance, Pending Legislation, Literature Review, State Initiatives, Issues for Consideration. Tables, 40-item bibliography, and 3 appendixes
