EIGHTEEN STANDARDS CONCERNING THE RIGHTS OF PERSONS UNDER THE CUSTODY OF THE UTAH DIVISION OF CORRECTIONS ARE SET FORTH BY THE UTAH COUNCIL ON CRIMINAL JUSTICE ADMINISTRATION.
Abstract
EACH STANDARD IS ACCOMPANIED BY AN ASSESSMENT OF THE STATUS OF THE UTAH CORRECTIONAL SYSTEM RELATIVE TO THE STANDARD AND BY SUGGESTED METHODS FOR IMPLEMENTING THE STANDARD. THE STANDARDS CONCERN ACCESS TO COURTS, TO LEGAL SERVICES, AND TO LEGAL MATERIALS; PROTECTION AGAINST PERSONAL ABUSE; HEALTHFUL SURROUNDINGS; MEDICAL CARE; SEARCHES; NONDISCRIMINATORY TREATMENT; REHABILITATION; RETENTION AND RESTORATION OF RIGHTS; RULES OF CONDUCT; DISCIPLINARY PROCEDURES; PROCEDURES FOR NONDISCRIMINATORY CHANGES OF STATUS; GRIEVANCE PROCEDURE; FREE EXPRESSION AND ASSOCIATION; EXERCISE OF RELIGIOUS BELIEFS; ACCESS TO THE PUBLIC; AND REMEDIES FOR VIOLATION OF OFFENDERS' RIGHTS. THE STANDARDS WERE DEVELOPED IN LIGHT OF JUDICIAL REVIEW OF CORRECTIONAL PRACTICES AGAINST THREE CONSTITUTIONAL DEMANDS, I.E., THAT STATE ACTION MAY NOT DEPRIVE CITIZENS OF LIFE, LIBERTY, OR PROPERTY WITHOUT DUE PROCESS OF LAW; THAT STATE ACTION MAY NOT DEPRIVE CITIZENS OF THEIR RIGHT TO EQUAL PROTECTION OF THE LAW; AND THAT THE STATE MAY NOT INFLICT CRUEL OR UNUSUAL PUNISHMENT.
