ETHICAL AND CONSTITUTIONAL ARGUMENTS AGAINST PROPOSED ALTERATIONS OF PRISONERS' BEHAVIOR BY ELECTRONIC STIMULATION OF THE BRAIN.
Abstract
TECHNOLOGICAL ADVANCES HAVE LED TO PROPOSALS FOR USING MIND-BEHAVIOR CONTROL TECHNIQUES ON PRISONERS AND MENTAL PATIENTS. THE AUTHOR CONTENDS THAT FIRST AMENDMENT PROTECTIONS OF FREEDOM AND THE RIGHT TO PRIVACY SHOULD PREVENT THE APPLICATION OF THESE TECHNIQUES ON UNWILLING SUBJECTS. HE ALSO CONSIDERS THE INMATE'S CAPACITY OR LACK THEREOF TO MAKE AN INFORMED CONSENT TO SUCH TREATMENT, AND JUDICIAL REVIEW OF ADMINISTRATIVE DECISIONS TO USE THIS FORM OF CONTROL.
