A REVIEW AND DISCUSSION OF JUDICIAL DECISIONS BEARING ON THE USE OF POLYGRAPHS AS INVESTIGATIVE TOOLS, ON CONFESSIONS MADE TO POLYGRAPH OPERATORS, AND ON THE USE OF POLYGRAPH TESTS AS CONDITIONS FOR EMPLOYMENT.
Abstract
IT IS NOTED THAT ADMISSIONS AND CONFESSIONS MADE TO POLYGRAPH OPERATORS PRIOR, DURING, OR AFTER TAKING A POLIGRAPH TEST ARE ADMISSIBLE AS EVIDENCE; HOWEVER, THE ADMISSION OR CONFESSION MUST HAVE BEEN MADE VOLUNTARILY. IF THE TEST IS ADMINISTERED BY LAW ENFORCEMENT OFFICERS OR BY A PRIVATE OPERATOR WHILE THE SUBJECT IS IN POLICE CUSTODY, MIRANDA WARNINGS MUST ALSO BE GIVEN PRIOR TO ANY QUESTIONING BY THE POLYGRAPH OPERATOR. FOR PART ONE, SEE NCJ-29852.
