Jurisdictional issues concerning child sexual abuse cases in Indian country are discussed.
Abstract
This resource package contains information concerning federal and tribal jurisdiction over child sexual abuse cases in Indian country, Federal prosecution/declination procedures, independent tribal prosecution procedures, and procedures to improve tribal/Federal coordination. Included in the materials are copies of relevant federal statutes, U.S. Supreme Court cases, a guide to Federal prosecution of child sexual abuse in Indian country prepared by an assistant U.S. attorney, a flow chart of the handling of child sexual abuse cases, a listing of victim-witness coordinators with mailing addresses and telephone numbers, a brief description of the Federal Victim/Witness Program operated by the U.S. Attorney's Office in the District of South Dakota, and information concerning the National Association of Crime Victim Compensation Boards with a listing of crime victim compensation program contacts.
