EXAMINATION OF THE CURRENT AND FUTURE IMPACT OF TECHNOLOGY ON THE DISCRETION OF THE PROSECUTOR IN LIGHT OF CASE LAW AND IDENTIFIABLE TRENDS OF INCREASED RELIANCE ON AUTOMATED INFORMATION SYSTEMS WITHIN THE PROFESSION.
Abstract
CASE LAW ON PROSECUTORIAL DISCRETION REFLECTING JUDICIAL REFUSAL TO INTERVENE IN THE EXERCISE OF THE PROSECUTORIAL FUNCTION. CURRENT USES OF AUTOMATION AND TECHNOLOGY, ESPECIALLY THE PROSECUTOR'S MANAGEMENT INFORMATION SYSTEM (PROMIS), TO GATHER DATA HELPFUL IN MONITORING AND CONTROLLING ABUSES OF PROSECUTORIAL DISCRETION ARE DISCUSSED. THE FUTURE USE OF THIS TECHNOLOGY IN IDENTIFYING THE LIMITS OF A VALID EXERCISE OF DISCRETION IN INDIVIDUAL CASES IS DESCRIBED.
