THREE SHORT CRITIQUES OF THE SENTENCING PROCESS.
Abstract
THE FIRST SUGGESTS THAT SENTENCING SHOULD FOCUS ON THE NATURE OF THE CRIMINAL ACT, THE MODE OF DETERRENCE, AND THE OFFENDER. THE SECOND RECOMMENDS A CONSCIOUS COOPERATION AND DIVISION OF RESPONSIBILITY BETWEEN THE SENTENCING JUDGE AND THE PAROLE BOARD. THE THIRD SUPPORTS THE CONCEPT OF A SEPARATE SENTENCING AUTHORITY BUT URGES THAT IT NOT BE COMPLETELY INDEPENDENT OF JUDICIAL CONTROL.
