Abstract
It summarizes the six types of probation presently recognized by Texas law: regular felony probation, regular misdemeanor probation, felony deferred adjudication probation, misdemeanor deferred adjudication probation, community service deferred adjudication probation, and conditional discharge. Probation eligibility conditions and procedures for obtaining misdemeanor or felony probation are described. Functions, contents, and disclosure of the presentence investigation report are discussed as are litigating disputes concerning the report. Probation conditions (statutory and nonstatutory) are described, and procedures for determining the amount of restitution to be ordered and for modifying probation conditions are noted. Probation supervision issues are addressed, including privacy and confidentiality concerns and investigating procedures regarding probation violations. Probation revocation (arrest and detention of the probationer, motion to revoke probation, the revocation hearing) is discussed along with the collateral consequences of a criminal conviction. Finally, the civil liability of probation officers for official acts or omissions is addressed as it relates to Texas and Federal law. Footnotes and an index are included.
