FUNCTIONS, OPERATIONS, AND METHODOLOGIES USED WITHIN THE SWEDISH FORENSIC-PSYCHIATRIC SYSTEM AS THEY APPLY TO THE LEGAL SYSTEM'S HANDLING OF THE MENTALLY ILL OFFENDER.
Abstract
THE STUDY DESCRIBES THE LEGISLATIVE FRAMEWORK WHICH GOVERNS THE DISPOSITION OF CASES IN WHICH MENTAL ABNORMALITY IS THE ISSUE. THE FOCUS SHIFTS TO THE INVESTIGATION STAGE OF CASES DURING WHICH DECISIONS ON WAIVERS OF PROSECUTION ARE MADE. THE STUDY DEVELOPS A DESCRIPTIVE MODEL OF THE FORENSIC-PSYCHIATRIC SYSTEM BASED ON DATA ANALYSIS OF CASES PROCESSED BY THE VARIOUS FORENSIC-PSYCHIATRIC UNITS THROUGHOUT SWEDEN IN 1967. IN 1965 THE LAW WAS CHANGED SO THAT ON ITS FACE THE EQUIVALENT OF THE INSANITY DEFENSE WAS ABOLISHED. (AUTHOR MODIFIED)
