A GENERAL SURVEY AND ANALYSIS OF THE SUSPENDED SENTENCE AS A LEGAL INSTITUTION, INCLUDING A REVIEW OF ITS DEVELOPMENT AND CURRENT USE IN FRANCE AND OTHER EUROPEAN COUNTRIES.
Abstract
THE BOOK BEGINS WITH A STUDY OF THE ORIGINS OF THE PRACTICE OF THE SUSPENDED SENTENCE UP TO THE FRANCOBELGIAN LEGISLATION OF THE LATE NINETEENTH CENTURY. IT THEN LOOKS IN TURN AT THE NATURE OF SUSPENDED SENTENCE FROM THE LEGAL POINT OF VIEW--ITS PRINCIPLES, THE CONDITIONS FOR ITS APPLICATION, AND ITS EFFECTS--AND AT THE SPREAD OF THE APPLICATION OF SUSPENDED SENTENCE DURING THIS CENTURY. THE BOOK ENDS WITH SOME COMPARATIVE CONCLUSIONS SUPPORTED BY A WIDE RANGE OF STATISTICS DRAWN FROM MANY PARTS OF THE WORLD. A STATISTICAL APPENDIX IS ALSO PROVIDED, INCLUDING INFORMATION ON CASES SUSPENDED, VARIATIONS IN APPLICATIONS OF THE SUSPENDED SENTENCE, AND ANALYSES OF SUSPENDED SENTENCES BY SUCH FACTORS AS TYPE OF OFFENSE, SEX, AND AGE.
