This study surveyed State correctional institutions to determine whether or not they have incorporated a meaningful fulfillment of the right to access to the courts by establishing a system of inmate representation or a law library within the institution.
Abstract
The article examines the evolving rights of access to the courts for postconviction proceedings and the state of the art of prison legal assistance and prison law libraries. It discusses at length the composition of the survey questionnaire developed from decisions and State and Federal regulations structuring the constitutional rights of prisoners to counsel and other forms of legal assistance. The survey questionnaire and results are appended. A total of 252 footnotes are included.
