CASE LAW CONCERNED WITH INMATE ACCESSIBILITY TO PUBLISHED MATERIALS.
Abstract
MOST OF THE DECISIONS LISTED DEAL DIRECTLY WITH LIBRARY CONCERNS - OTHERS WITH CLOSELY RELATED ISSUES, SUCH AS THE POSSESSION OR SHARING OF PERSONALLY OWNED BOOKS AND PERIODICALS, OR THE PURCHASE OF PUBLISHED MATERIALS THROUGH THE MAIL. MOST ARE FEDERAL COURT INTERPRETATIONS OF CONSTITUTIONAL RIGHTS, THEIR INFLUENCE EXTENDS TO EVERY CORRECTIONAL INSTITUTION IN THE UNITED STATES AND WILL CONTINUE TO DO SO UNLESS REVERSED BY A DECISION OF A HIGHER COURT. OTHERS HAVE VARYING DEGREES OF APPLICABILITY DEPENDING UPON THE PARTICULAR CIRCUMSTANCES OF THE CASE AND THE BASIS OF LAW UPON WHICH THEY REST. THOSE BASED ON STATE LAW RATHER THAN FEDERAL WOULD NOT CARRY A MANDATE OUTSIDE OF THE STATE OF ORIGIN. ALL OF THE DECISIONS, HOWEVER, HAVE GREAT PERSUASIVENESS WHEREVER SIMILAR ISSUES ARE TO BE DECIDED. CASES ARE LISTED BY TOPIC WITH FULL CITATIONS AND A SHORT SUMMARY GIVING THE HOLDING OF EACH CASE.
