An international expert group, organized by the International Institute of Higher Studies in Criminal Sciences and the International Association of Penal Law, in cooperation with the United Nations Secretariat, drafted a model treaty on the transfer of enforcement of penal sanctions.
Abstract
The model treaty applies to four types of sanctions, including deprivation of liberty, fines, confiscations, and disqualifications. The treaty covers definitions, principles, dual criminality, mandatory grounds for refusal of enforcement, optional grounds for refusal, and reasons for refusal. Other topics included in the model treaty are communications, required documents, language, certification and authentication, provisional measures, effects of the transfer for the sentencing State and for the administering State, conversion of the sanction, amnesty and pardon, and costs.
