The Assistant Attorney General of the Department of Justice's Antitrust Division presents statistics on the division's enforcement activities for fiscal 1987 and the first half of fiscal 1988, describes its efforts to challenge mergers and acquisitions, and justifies its requests for increased staff.
Abstract
The division's primary enforcement activity is vigorous prosecution of horizontal antitrust violations such as price fixing, bid rigging, and market allocations among competitors. During fiscal 1987, the division filed 92 criminal cases and recovered nearly $1.1 million damages suffered by the United States as a result of antitrust violations. During the first 5 months of fiscal 1988, the division accelerated its pace and filed 38 criminal cases. It has also distributed a pamphlet designed to educate the public about antitrust violations and encourage reporting of anticompetitive conduct. A substantial portion of the division's resources were devoted to review of Hart-Scott-Rodino premerger notification filings. The statement emphasizes that the division's productivity has increased as its number of attorneys has decreased. The division seeks a program increase of 25 workyears.
