Intended primarily for Federal firearms licensees, this booklet presents State laws that govern the sale of firearms.
Abstract
The State laws presented were selected because of their relevancy to the effective administration of the Federal Gun Control Act of 1968, as amended. Seven criteria were used in the selection of the firearms laws and ordinances included in this publication. They must prohibit the sale, possession, or receipt of any type of firearm or allow any exception to the prohibitions; or they may prohibit the sale, possession, or receipt of any type of firearm to or by any particular class of persons. Laws included may also restrict the sale, possession, or receipt of firearms such as destructive devices, fully automatic weapons, short-barreled rifles, short-barreled shotguns, and silencers. Also included are laws that require waiting period or notification to law enforcement officials before weapons may be delivered to purchasers, as well as laws that require a permit/ license, or a State/local ID card before a weapon may be sold or delivered to a purchaser or recipient. Other laws included may restrict the age at which it is lawful for a person to purchase or receive a firearm, or may restrict the sale of firearms. Laws not included pertain to the carrying of weapons, the discharge of weapons, and notification to designated officials after the sale and delivery have been made. A reference table cites whether a State has a purchaser waiting period, State purchaser requirement, State license/permit to purchase, State license for dealers and manufacturers, State licensee record-keeping requirements, and State-local government limits. The body of the booklet contains the provisions for the various laws by State.
