TESTIMONY IS GIVEN CONCERNING ACCESS TO FEDERAL COURTS AND THE SUPREME COURT IN RELATION TO THE INCREASING AND UNMANAGEABLE WORKLOAD OF THESE COURTS.
Abstract
WITNESSES INCLUDE LEGAL ATTORNEYS, CITIZENS LITIGATION GROUP REPRESENTATIVES, PROFESSORS OF LAW, A REPRESENTATIVE FROM THE AMERICAN BAR ASSOCIATION, AND FEDERAL JUDGES. THEIR TESTIMONY AND STATEMENTS CONSIDER THE RIGHT OF CITIZENS TO HAVE ACCESS TO FEDERAL COURTS IN CASES DEALING WITH CONSUMER RIGHTS, DISPUTE-SETTLEMENT, AND CLASS ACTIONS VIS-A-VIS THE INCREASINGLY UNMANAGEABLE CASELOAD BEING HANDLED BY THESE COURTS. ALLOCATION OF SCARCE RESOURCES TO FEDERAL COURTS, DIVERSION OF CASES TO OTHER FORUMS, AND INTERCIRCUIT CONFLICTS ARE ALSO DISCUSSED. THE CHAIRPERSON OF THE AMERICAN BAR ASSOCIATION PRESENTS TESTIMONY ON ADMINISTRATIVE LEGISLATION AND REVISION OF REGULATIONS. THE ATTITUDE OF THE CITIZENRY ON THE ISSUE OF JUDICIAL ACCESS AND THE POLICIES OF THE JUDICIAL CONFERENCE ARE ALSO CONSIDERED. A SUMMARY OF RECOMMENDATIONS OF THE COMMISSION ON REVISION OF THE FEDERAL COURT APPELLATE SYSTEM IS PRESENTED. APPENDIXES INCLUDE SUPPLEMENTAL MATERIALS SUCH AS ANNUAL REPORTS, SURVEYS OF STATE LAWS, LEGISLATIVE PROPOSALS, AND FEDERAL JUDGE SELECTION. (DAG)
