A MODEL ACT FOR STATE-ADMINISTERED ADULT PROBATION AND PAROLE SYSTEMS, ISSUED IN 1955 BY THE NATIONAL PROBATION AND PAROLE ASSOCIATION, IS PRESENTED, TOGETHER WITH COMMENTS ON EACH SECTION OF THE ACT.
Abstract
A REVISION OF THE ASSOCIATION'S 1940 MODEL LAW, THE STANDARD PROBATION AND PAROLE ACT MAY SERVE AS A PLAN FOR COMBINED PROBATION AND PAROLE SYSTEMS, FOR SEPARATE PROBATION AND PAROLE ACTS, OR FOR SEPARATE ADMINISTRATIONS OF PROBATION AND PAROLE. IN ADDITION TO UPDATING THE EARLIER VERSION, THE 1955 ACT ADDS A MODEL PROVISION FOR CONDITIONAL RELEASE. THE ARTICLES AND SECTIONS OF THE ACT COVER THE FOLLOWING: (1) CONSTRUCTION AND PURPOSE, (2) STATE BOARDS (APPOINTMENT, DUTIES, TERMS, COMPENSATION, REMOVAL, ORDERS, RECORDS, ANNUAL REPORT, AUTHORITY TO ESTABLISH RESIDENCES AND TREATMENT FACILITIES FOR PROBATIONERS AND PAROLEES), (3) EMPLOYEES (STAFF TO BE APPOINTED, COMPENSATION, DUTIES OF THE DIRECTOR, DUTIES OF PROBATION AND PAROLE OFFICERS), (4) SENTENCE (INVESTIGATION, SENTENCE AND MODIFICATION, INFORMATION FROM COURTS), (5) PROBATION AND SUSPENSION OF SENTENCE (CONDITIONS OF PROBATION OR SUSPENSION, PERIOD OF PROBATION OR SUSPENSION, ARREST AND SUBSEQUENT DISPOSITION, ETC.), (6) PAROLE AND CONDITIONAL RELEASE (PAROLE AUTHORITY AND PROCEDURE, CONDITIONAL RELEASE, PAROLE FROM LOCAL INSTITUTIONS, INFORMATION FROM PRISON OFFICIALS AND OTHERS, AUTHORITY TO SUBPOENA WITNESSES AND RECORDS, PROVISIONS FOR PAROLEES, RETURN OF PAROLE VIOLATORS, SERVICE OF TERM FOR ADDITIONAL CRIMES, DISCHARGE AND RESTORATION OF CIVIL RIGHTS), (7) EXECUTIVE CLEMENCY, AND (8) APPLICATION OF THE ACT.
