THIS DETAILS THE EXTENT TO WHICH SOUTH CAROLINA IS NOW IN COMPLIANCE WITH DEPARTMENT OF JUSTICE REGULATIONS FOR THE HANDLING OF CRIMINAL HISTORY INFORMATION AND CHANGES BEING MADE TO BRING THE ENTIRE SYSTEM INTO COMPLIANCE.
Abstract
MAJOR ISSUES COVERED BY THESE REGULATIONS ARE: COMPLETENESS AND ACCURACY OF CRIMINAL HISTORY RECORD INFORMATION WITH SPECIAL ATTENTION TO INCLUSION OF DISPOSITIONS; LIMITS ON DISSEMINATION WITH PROCEDURES FOR DETERMINING WHO IS AUTHORIZED; AUDITS AND QUALITY CONTROLS TO INSURE AGENCY COMPLIANCE AND RECORD INTEGRITY; SECURITY REQUIREMENTS FOR HARDWARE, PHYSICAL FACILITIES, AND PERSONNEL; AND THE INDIVIDUAL'S RIGHT OF ACCESS AND REVIEW OF INFORMATION WITH PROCEDURES FOR CHALLENGING AND CORRECTING INFORMATION FOUND INACCURATE OR INCOMPLETE. CURRENTLY, PRIMARY EMPHASIS IN SOUTH CAROLINA IS ON THE STATEWIDE CRIMINAL JUSTICE INFORMATION SYSTEM AND THE TELECOMMUNICATIONS SYSTEM. FOR THIS REASON, THE PLAN CONCENTRATES ON THE CENTRAL STATE REPOSITORY. HOWEVER, SIMILAR REGULATIONS WILL APPLY TO THE SMALL, MANUAL RECORDKEEPING SYSTEMS OF LOCAL AGENCIES. INCLUDED ARE: A FLOW CHART GIVING THE RESPONSIBLE AGENCY FOR EACH STEP OF THE CRIMINAL JUSTICE RECORD PROCESS; TERMS AND DEFINITIONS USED; A LIST OF OFFENDER BASED TRANSACTION DATA ELEMENTS; A DISCUSSION OF APPLICABILITY AND IMPACT OF THE REGULATIONS FOR VARIOUS AGENCIES, INCLUDING A CHECKLIST; THE PROPOSED USE AND DISSEMINATION AGREEMENT; THE PROPOSED NONDISCLOSURE AGREEMENT FOR RESEARCHERS; CURRENT SOUTH CAROLINA LEGISLATION ON JUVENILE RECORDS AND INFORMATION; AND A COPY OF SECTION 524(B) OF THE OMNIBUS CRIME CONTROL AND SAFE STREETS ACT.
