The National Association of Chiefs of Police Drug Reduction Task Force conducted a survey in 1989 to identify State laws and legislation creating "Drug-Free School Zones" and availability control laws.
Abstract
Currently, 19 states have Drug-Free School Zone laws on their books, and 3 states have legislation pending. Delaware, Oregon, and West Virginia enforce Drug-Free School Zones through Federal mandate, and 14 states do not have and have not proposed legislation to create Drug-Free School Zones. At this time, 25 of 50 states have "availability control" laws which prohibit the distribution of alcohol and/or cigarettes within a certain area near schools or churches. In general, rehabilitation rather than punishment is the primary concern of the criminal justice system when juveniles violate Drug-Free School Zone laws. 1 table
