This police officer's handbook provides information on a search warrant case decided by the Fourth Circuit U.S. Court of Appeals (United States v. Anderson) and presents guidelines for the investigation of cases that involve the alleged abuse of elderly persons.
Abstract
The defendant's argument before the appellate court was that the search warrant was defective because the affidavit submitted to the magistrate did not contain facts to support probable cause that the items specified in the warrant (a pistol and a silencer) were located in the defendant's residence. The court rejected the defendant's argument, ruling that it was reasonable for the magistrate to believe that the defendant's gun and the silencer would be found in his residence. The guidelines for the investigation of elderly abuse cases address intake procedures, investigative procedures, and closure procedures. Aspects of intake procedures are notification and cross-reporting, planning and preparation, the location and protection of the victims, and the protection of evidence. Components of the investigation are interviewing and observing, collection of evidence, documentation, and joint investigation and cross- reporting.
