In order to obtain a group pf qualified, prospective jurors that is repsentative of the community, courts have tried to develop a list of eligible jurors that includes as high a percentage as possible of the total population. Much attention has been directed to this aspect of achieving jury representativeness. These efforts, many of which have not previously been published, are documented here.
Abstract
The article also examines the use of stratified selection procedures, whereby strata of race, age, or sex are sampled in proportion to the number in the population; this technique needs to be carefully considered as to its effect upon the equal probability of selection. The qualification and summoning system is also examined since the representativeness achieved by the lists and by random selection can be impaired by this process. (Publisher abstract)
