REVIEW OF THE NEW JERSEY SUPREME COURT DECISION RELATING TO THE ADMISSIBILITY OF POLYGRAPH EVIDENCE IN STATE V MCDAVITT (1972).
Abstract
THE COURT HELD THAT POLYGRAPH EVIDENCE IS ADMISSIBLE WHEN CERTAIN STANDARDS ARE MET IN OBTAINING CONSENT FROM THE DEFENDANT AND ADMINISTERING THE TEST. PREVIOUS JUDICIAL POLICIES REGARDING THE ADMISSIBILITY OF POLYGRAPH EVIDENCE IN CRIMINAL CASES AND THE CRITERIA GENERALLY EMPLOYED BY COURTS IN RULING ON THE ADMISSIBILITY OF SCIENTIFIC EVIDENCE ARE DISCUSSED. THE IMPLICATIONS OF THE MCDAVITT DECISION ARE ALSO CONSIDERED.
