EXAMINATION OF THE JUVENILE DEFENSE ATTORNEY'S ROLE IN A DELINQUENCY HEARING BASED ON THE ACTS OF A JUVENILE WHICH WOULD CONSTITUTE A PUBLIC OFFENSE IF COMMITTED BY AN ADULT.
Abstract
AN HISTORICAL OVERVIEW OF THE ROLE OF THE JUVENILE DEFENSE ATTORNEY IS PRESENTED. THE THEORETICAL AND PRACTICING ROLES EMANATING FROM THE SUPREME COURT DECISION IN RE GAULT WHICH HELD THAT A FACT FINDING ADJUDICATORY HEARING INVOLVING A JUVENILE CHARGED WITH A PUBLIC OFFENSE IF TO BE MEASURED BY DUE PROCESS STANDARDS ARE DISCUSSED. THE AUTHOR CONCLUDES THAT THE PROPER ROLE FOR DEFENSE COUNSEL AT A DELINQUENCY PROCEEDING IS THE ROLE OF ADVOCATE.
