JUDICIAL HOLDINGS ON INMATE RIGHTS ARE CATEGORIZED BY THE ISSUES RAISED, BASES OF DENIAL, AND TYPES OF RELIEF, AND THEN HISTORICAL TRENDS IN THE DECISIONS ARE IDENTIFIED.
Abstract
PRISONER RIGHTS WHICH ARE CONSIDERED, RELATE TO COMMUNICATION WITH THE OUTSIDE WORLD, ESPECIALLY WITH ATTORNEYS AND COURTS, FREEDOM OF RELIGION, DUE PROCESS, AND EQUAL PROTECTION OF THE LAWS. JUDICIAL EXTENSION OF RIGHTS TO INMATES HAS RECENTLY BEEN SUBSTANIAL, ESPECIALLY IN THE NEW YORK AND CALIFORNIA STATE COURT AND MOST FEDERAL COURTS. IN ADDITION TO EVALUATING THE CONTENT OF THESE CASES, THE AUTHOR USES A CLASSIFICATION SCHEME AND CASE TABLES TO ILLUSTRATE PROGRESS IN THE FIELD.
