THIS ARTICLE ATTEMPTS TO DETERMINE BEHAVIORAL AND SOCIAL CRITERIA ON WHICH TO BASE PREDICTIONS OF RECIDIVISM OR SUCCESS IN REHABILITATION, BASED ON A SURVEY OF 1,493 YOUTHFUL OFFENDERS.
Abstract
IT COMPARES THE STATE OF RESEARCH BOTH IN JAPAN AND OTHER COUNTRIES CONCERNING RECIDIVISM, TOGETHER WITH PROSPECTS FOR REHABILITATION OF JUVENILE OFFENDERS ON PROBATION. IT PRESENTS REHABILITATION EXPECTATION STANDARDS WHICH CAN BE USED IN PRACTICAL FORM BY JUVENILE COURTS AND PROBATION AUTHORITIES IN DETEMINING SENTENCE SUSPENSION, PROBATION CONDITIONS, ETC. A SURVEY WAS MADE OF 1,493 SUBJECTS. OF THESE, 215 WERE UNDER 16, 519 WERE 16 TO 17, AND 759 WERE 18 OR OLDER. NUMEROUS FACTORS WERE TAKEN INTO ACCOUNT AS EVALUATION CRITERIA, INCLUDING EFFECTS OF HOME LIFE, OCCUPATION OR SCHOOL, BAD ASSOCIATES, POVERTY, LIVING AWAY FROM HOME, EARLY CRIMINAL BEHAVIOR, SEVERITY OF OFFENSES, PREVIOUS HISTORY OF INSTITUTIONALIZATION, ATTITUDE WHILE UNDER PROBATION, USE OF DRUGS, AND EXCESSIVE CONSUMPTION OF ALCOHOL. A CORRELATION WAS DEVELOPED BETWEEN THE CRITERIA ESTABLISHED AND LEVELS OF POSTRELEASE BEHAVIOR: I.E., (1) NO OFFENSES-NO REARRESTS AND NO TIME WHEN WHEREABOUTS WERE UNKNOWN; (2) LIGHT OFFENSES-WHEREABOUTS AT TIMES WERE NOT ACCOUNTED FOR, THERE WERE MATTERS WHICH COULD BE HANDLED AT THE FAMILY COURT LEVEL; AND (3) PROCESSSED OFFENDERS--CASES WHERE PROCEEDINGS WERE BROUGHT.
